The Board of Appeals
The Board of Appeals meets and exercises its powers in any part of the County of Hawaii. Except as provided by law, all of its meetings are open to the public. BOA addresses any petition appealing the decisions by the Planning Director in the enforcement of Zoning and other Planning codes, the Chief Engineer in the enforcement of building codes, and decisions by the Planning Commission. The Windward and Leeward Planning Commissions
The two Planning Commissions, consisting of members appointed from within each judicial district, advise the Mayor, County Council, and the Planning Director on land-use matters pursuant to law and the Hawai’i County Charter. This includes review and recommendation of amendments to the General Plan; adoption of, or amendments to, Community Development Plans; changes of zone; and amendments to the Zoning and Subdivision Codes. They also review and may act upon other land use applications such as Special Permits and Special Management Area Use Permits. These Commissions conduct public hearings at least once per month and are one of the most active and important boards in County government. Community Development Plan (CDP) Action Committees
The County CDPs are action-oriented. The process is focused to result in practical and pragmatic implementation; where possible, small actions are acknowledged and implemented concurrently while the plan is being developed. The Action Committees for each CDP clearly sorts out the implementing actions to identify:
- Land use amendment requirements
- Other regulatory changes
- Budgetary items
- Community implementation actions
Kailua Village Design Commission (KVDC)
The KVDC reviews and makes recommendations to the Planning Director on proposed projects within the Kailua Village Special District that require Plan Approval. These approvals must occur prior to Building Permit approval.
Cultural Resources Commission
The intent of the Hawai‘i County Cultural Resources Commission, Article 44 of the Hawai‘i County Code, adopted by Ordinance 08-42, is to provide for:
- Protecting and preserving historic properties and artifacts in the County and encourage, where appropriate, their adoption for appropriate and feasible use;
- Encouraging the restoration, rehabilitation and continued functional use of historic properties;
- Encouraging the identification, preservation, promotion, and enhancement of those historic properties which represent or reflect distinctive elements of cultural, social, economic, political, and architectural history, and to encourage the designation of historic properties, thereby ensuring that our cultural and historic heritage will be imparted to present and future generations of residents and visitors; and
- Formulating County-wide comprehensive, historic preservation policies, programs, and plans.
The nine members of the County Cultural Resources Commission will be appointed by the Mayor, and approved by the County Council. Representation may include professionals and persons with special interest in architecture, history, archaeology, architectural history, Hawaiian Culture, ethnic history, and culture of Hawai‘i County.
